Terms and Conditions of Service

LEGAL NOTICE: THIS AGREEMENT CONTAINS A MANDATORY ARBITRATION PROVISION AND A CLASS ACTION WAIVER. IT LIMITS YOUR LEGAL RIGHTS AND REMEDIES IN THE EVENT OF A DISPUTE. BY USING H2H DATING, YOU WAIVE YOUR RIGHT TO A JURY TRIAL.

1. BINDING CONTRACT

By accessing, browsing, or creating an account on H2H Dating, you agree to be bound by these Terms and Conditions. This is a legally binding contract between you and H2H Dating and its owners/operators. If you do not agree to every clause, you must immediately cease all use of the platform.

2. ELIGIBILITY & USER REPRESENTATIONS

You represent and warrant that:

  • You are at least 18 years of age.
  • You have never been convicted of a felony or any crime involving violence, sexual misconduct, or harassment.
  • You are not a registered sex offender in any jurisdiction.
  • You have the legal capacity to enter into this agreement.

3. NO BACKGROUND CHECKS OR SCREENING

YOU UNDERSTAND THAT H2H DATING AND ITS OWNERS/OPERATORS DOES NOT CONDUCT CRIMINAL BACKGROUND CHECKS ON ITS MEMBERS. WE DO NOT VERIFY THE ACCURACY OF USER PROFILES OR THE IDENTITY OF USERS. YOU ASSUME ALL RISK ASSOCIATED WITH INTERACTING WITH OTHER USERS, BOTH ONLINE AND IN PERSON.

4. MAXIMUM LIMITATION OF LIABILITY

To the maximum extent permitted by applicable law, H2H Dating and its owners/operators shall not be liable for any direct, indirect, incidental, special, or consequential damages, including but not limited to bodily injury, emotional distress, death, or financial loss, resulting from your use of the service or your interactions with other users.

LIABILITY CAP: IN NO EVENT SHALL THE TOTAL AGGREGATE LIABILITY OF H2H DATING AND ITS OWNERS/OPERATORS EXCEED THE TOTAL AMOUNT PAID BY YOU TO THE SITE IN THE SIX MONTHS PRIOR TO THE CLAIM, OR $100.00 USD, WHICHEVER IS LESS.

5. INDEMNIFICATION (HOLD HARMLESS)

You agree to indemnify, defend, and hold harmless H2H Dating and its owners/operators, its officers, directors, employees, and agents from and against any and all claims, damages, losses, liabilities, and expenses (including attorney’s fees) arising out of your use of the site, your content, or your violation of these terms.

6. USER CONDUCT & SAFETY

You agree not to use H2H Dating to:

  • Harass, stalk, or harm another person.
  • Post sexually explicit, defamatory, or illegal content.
  • Solicit money or financial information from other users.
  • Create multiple accounts or "catfish" profiles.
We reserve the right to terminate your account at our sole discretion, without notice and without refund, for any behavior we deem inappropriate.

7. MANDATORY ARBITRATION & CLASS ACTION WAIVER

Any dispute or claim relating in any way to your use of H2H Dating will be resolved by binding arbitration, rather than in court. You and H2H Dating and its owners/operators agree that each may bring claims against the other only in an individual capacity and not as a plaintiff or class member in any purported class or representative proceeding.

8. INTELLECTUAL PROPERTY & CONTENT LICENSE

By posting content (photos, text, etc.) to H2H Dating, you grant us a non-exclusive, royalty-free, worldwide, perpetual license to use, host, and display such content. We own all rights to the H2H Dating software, branding, and design.

9. GOVERNING LAW

These terms shall be governed by the laws of the jurisdiction where the owner of H2H Dating is located, without regard to conflict of law principles.
